Will of Joane Heighes of Aylesford, Kent 21st March 1670.
Proved 14th September 1675. Ref : PROB11/348
I Joane Heighes of Aylesford in the county of Kent, Widow, the relict of Edward Heighes late of Binsted in the county of Southampton, Esquire. Being in health and of sound and perfect memory (purified be God), Do make and ordain this my last Will and Testament in manner and form following.
First, I bequeath and resign my soul unto God my creator, believing and hoping for my Salvation through the merits alone of Jesus Christ my Redeemer and my body to the Earth to be decently buried by my Executors hereafter named. And for the orderly disposing of that portion of worldly good which God of his great majesty hath been pleased to give and continue to use. My will is as followeth :-
I give and bequeath unto Sarah the wife of Henry Higford of Bexley in the county aforesaid, gent and daughter of my brother, Mr George Smith, deceased, the sum of one hundred pounds to be paid or retrieved within two months after my decease.
Item, I give unto Sarah Caulier the daughter of Sarah aforesaid, the wife of Henry Higford, the sum of fifty pounds to be paid within two months of my decease.
Item, I give and bequeath unto Joane the wife of Mr Thomas Tilson, Clerk and Minister of Aylesford aforesaid and daughter of my brother, John Smith, Merchant, the sum of one hundred pounds to be paid or retrieved within two months after my decease.
Item, I give and bequeath unto Heighes Tilson, the son of Mr Thomas Tilson, aforesaid, the sum of fifty pounds to be paid within two months after my decease.
Item, I give and bequeath unto Alice Smith the wife of my brother John Smith, aforesaid Merchant, the sum of fifty pounds to be paid within two months of my decease.
Item, I give and bequeath unto John Smith the son of my brother John Smith, aforesaid Merchant, the sum of fifty pounds to be paid within two months of my decease.
Item, I give and bequeath unto Margaret the wife of Antony Corkwell, and daughter of my sister Elizabeth, the sum of fifty pounds to be paid within two months of my decease.
Item, I give and bequeath unto Martha Wilson the daughter of my sister Sarah, the sum of fifty pounds to be paid within two months of my decease.
Item, I give and bequeath unto George Wilson Merchant, the son of my sister Sarah, the sum of fifty pounds to be paid within one year of my decease.
And the sum of fifty pounds to the children of Edward Stone Merchant, by Mary the daughter of my sister Sarah, to be equally divided between them and to be paid within one year of my decease. Upon condition that the said George Wilson and Edward Stone or either of them or the Executors or Administrators of the said Edward Stone shall deliver up Cancelled into the hands of my Executors without payment required or made all Bonds, Bills or Obligations whatsoever that have been heretofore made or entered into by Samuel Woodford of Binsted in the county of Southampton, Clerk, for the payment of any sum or sums of money to and for the use of the said Edward Stone and George Wilson or any others by virtue of any such obligation made or entered into by the said Samuel Woodford or give a general release to the said Samuel Woodford for that he be fully discharged from all such obligations or payments as aforesaid.
And if the said George Wilson and Edward Stone do or shall refuse or for one whole year [or-gl--st ?? possibly “obstruct”] for to do my will is that my Executors be acquitted of and not obliged to the payment of the aforesaid fifty pounds to the said George Wilson or that other aforesaid legacy of fifty pounds to the said children of Edward Stone aforesaid. But herewith and thereof to satisfy and pay the said Samuel Woodford fifty pounds Triumph or any such sum that shall be justified of him by virtue of any such obligation aforesaid.
Lastly I do constitute and appoint the aforesaid Sarah wife of the said Henry Higford and Joane the aforesaid wife of Thomas Tilson joint Executors of this my last Will and Testament, revoking all former Wills.
In witness whereof I have herewith set my hand and seal, the one and twentieth day of March in the year of Lord Christ one thousand six hundred and seventy.
